Terms and Conditions

Thank you for your interest in Helen’s Learn to Drive (HLTD).

  1. In these terms and conditions: (1) references to ‘we’, ‘us’ and ‘our’ are references to HLTD; and (2) references to ‘you’ and ‘your’ are references to the person booking the lesson or the individual driver for whom the lesson is booked as the case may be.  

  2. Like every company, we have terms and conditions of service.  Please read the below information; when you book a driving lesson online, we will ask you to click a checked box to confirm you have read and accept our terms and conditions.

Driving Lesson Bookings

3.   All bookings with HLTD are made online or, if online booking is not available, directly with the HLTD instructor.

  1. Automated text and email reminders are issued at the time of booking, and 48 hours prior to the start time of your driving lesson unless the lesson is scheduled to take place in less than 48 hours after booking.

  2. On-road lessons commence and end at the pre-determined pick-up point, determined at the time of booking the lesson. If requested, we may agree (but are not bound to) conclude the lesson at another location other than the pick-up point.

  3. The durations of standard on-road lessons is 90 or 120 minutes. This time includes time spent with the HLTD instructor briefing and/or debriefing you beforehand and afterwards, Accordingly, you agree that the length of a standard lesson will not necessarily correspond to time logged in your Queensland Learner Logbook, which may, in some cases be a lesser period.

  4. You must be ready to commence the lesson 10 minutes prior to the agreed pick-up time. If you do not turn up at the agreed time for your lesson, your HLTD instructor will wait 15 minutes and may at the instructor’s reasonable discretion deduct this from the total lesson time. 

  5. If you turn up later than 15 minutes after the agreed pick-up time, your HLTD instructor may in his/her reasonable discretion choose not to proceed with the lesson and in such circumstances you will be liable for the full cost of the lesson.

  6. While every endeavour is made to commence the lesson at the scheduled time and with the scheduled HLTD instructor, no responsibility can be taken for circumstances beyond our control which may delay the start time or result in a change of HLTD instructor. If there are circumstances beyond our control which have delayed the start time of your lesson, we will (subject to HLDT instructor availability) offer you the full lesson time or, if that is not possible, we will offer you a shorter lesson at a reduced pro rata rate.

  7. We reserve the right to reschedule a lesson for any reason subject to the provision of reasonable notice.

Payment Policy

  1. You can pay for a single driving lesson online at the time of booking your lesson, or by credit / debit card or cash prior to commencing the lesson. Please ensure you have the correct amount available as HLDT’s instructors do not carry change. 

  2. Bank transfers can be deposited in the HLTD bank account and must clear prior to the lesson (Please add the students name and date of lesson as reference).

Cancellation Policy

  1. You are required to give not less than 24 hours’ notice to cancel your lesson or to reschedule your driving lesson to another time/day. Please understand that we keep our vehicles and instructor’s time free for your booking and failure to attend often means another student has missed the opportunity to use that time and our costs need to be covered. 

  2. If you cancel with less than 24 hours’ notice given, you are liable to pay a fixed cancellation fee of $100. In our absolute discretion we may agree to waive this cancellation fee if we consider it appropriate in all the circumstances. Agreement to waive a cancellation fee is not an agreement to waive future cancellation fees. 

  3. If a lesson is cancelled within 2 hours of the agreed pick-up time, or you fail to attend your lesson at all for any reason, you are liable to pay the lesson fee. In our absolute discretion we may agree to waive the lesson fee if we consider it appropriate in all the circumstances. Agreement to waive a lesson fee in these circumstances is not an agreement to waive future cancelled lesson fees. 

  4. If HLTD has to cancel your lesson, a rescheduled time/date will be offered if available 

 Refund Policy

  1. If you cancel a pre-paid driving lesson or pre-paid block of lessons with more than 24 hours’ notice, a full refund less 10% merchant/administration fee will be granted.

  2. As block bookings attract a discounted lesson rate, if you cancel any unused lessons forming part of that block booking, any lessons that have been completed as part of that block booking will be charged at the full individual driving lesson price. The amount of any refund will be calculated as the amount of the block booking less the cost of completed lessons calculated as aforesaid and less a 10% merchant/administration fee.

  3. All refunds will be processed back onto a credit/debit card or to a bank account.  No refunds will be made in cash.

  4. Prepaid blocks of lessons are non transferable and must be used within 12 months of purchase.

Non-Payment Policy

  1. Should you fail to pay for any service provided by HLTD within the terms and conditions of your individual agreement with us, no future bookings will be accepted until full payment of all outstanding amounts has been made. We reserve the right to assign any outstanding debts will be transferred to a collections agency after 30 days.  Any additional costs incurred for recovery of the debt will be solely at your expense.

Conditions For Training With Helen’s Learn to Drive

  1. We agree to train you in the safe operation of driving a motor vehicle subject to the following representations which you warrant are correct: -

    1. all of the information that you have provided to HLTD is true;

    2. you hold a current Australian driving licence (Class C LRN or CA), or equivalent overseas licence, which you will carry with you at all times during a lesson; and

    3. if you have an overseas licence, you confirm that you have not previously sat and failed a driving test within Queensland (if you have you need to apply for a QLD Learners licence to undertake lessons).

  2. You agree that if any further information is required in relation to your driving history, you will acquire it through the relevant Government Departments at your own expense.

  3. You agree that you will comply with any conditions applicable to your licence including any medical conditions such as wearing glasses.

  4. You must comply with the instructions or directions of your instructor at all times, before and during a lesson.

  5. HLTD accepts no liability whatsoever for personal property that is left in any instructor supplied vehicle.

  6. You undertake to:

    1. inform the driving instructor if any exercise you are asked to perform is not within your current ability to perform it at a safe standard.

    2. obey all traffic regulations and laws of QLD whilst driving the training vehicle. Any penalties and/or infringement notices issued during the lesson are the sole responsibility of you as the driver of the vehicle. 

    3. to inform the driving instructor, prior to when training commences, of any circumstances, such as any medical condition, or medication taken (either prescribed or non-prescribed), alcohol or recreational drug use that would cause them to be over the prescribed legal limit or unable to operate a motor vehicle safely. 

  7. We reserve the right to refuse to provide a lesson where you are, or where we consider you to be, unfit to operate a vehicle, or are suspected to be under the influence of drugs or alcohol as reasonably determined by us. If a lesson is cancelled on account of any of the foregoing, it is at the discretion of HLTD to charge the full amount of the lesson. 

  8. You agree to indemnify us in relation to all consequences of any damage caused by you to any person or property (including motor vehicles) whilst you are the driver of the vehicle.

  9. During the training, you will not drive a vehicle in any manner that contravenes any law. You understands that driving a vehicle could be potentially hazardous and you participate in training entirely at their own risk. 

  10. Driving lessons cannot take place in your own vehicle unless you have at least one full lesson with us to assess your driving in our dual control supplied car. If your instructor agrees to provide lessons in your own car after this assessment, you warrant that your car is in a roadworthy condition and that it is covered by compulsory third party and comprehensive insurance and that you have the legal owner’s permission to use the car. HLTD and our driving instructors accept no responsibility whatsoever for traffic infringements or accidents resulting from a learner having driving lessons in their own car.

  11. If an accident does occur while under instruction or during a test with an examiner a $1000 excess is payable
